This Privacy Policy (“Policy”) is drafted in accordance with the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. It explains how TMA Drive Solutions Private Limited, having its registered office at 28,Pragati Industrial Complex, Kothrud, Pune 411038 (“TMA Drive,” “Company,” “we,” “us,” or “our”), collects, uses, stores, processes, discloses, and protects information in connection with our website https://tmadrive.com (the “Platform”). We are engaged in the manufacture of Electrical Machines and Electronic Equipements.
For our operations and related purposes, we onboard and engage with various suppliers who sell their products to the Company for ultimate use by our end‑customers (each a “Supplier,” “you,” or “your”). This Policy governs how we handle information—including business and personal information—provided by a Supplier during the course of the Supplier’s engagement with the Company via the Platform. This Policy is a legal agreement between the Supplier and the Company as the owner of the Platform. Suppliers must be natural persons at least 18 years of age. If you are under 18, please read this Policy with a parent or legal guardian; in such case, the Policy will be deemed a contract between the Company and your parent or legal guardian and, to the extent permitted by law, enforceable against you.
1. Supplier’s Consent
Your onboarding and use of the Platform is subject to your acceptance of this Policy. You consent to be bound by this Policy by any of the following:
- Accessing or using the Platform;
- Onboarding with the Company for the sale and purchase of your products;
- Submitting any information at our request.
As part of our engagement, we may send routine communications via email, SMS, WhatsApp, phone calls, or other messaging channels. By engaging with us, you agree to receive such communications as necessary. This Policy does not apply to third‑party websites or applications linked from the Platform. If you do not agree with this Policy, please discontinue use of the Platform. You may revoke consent for certain actions; however, revocation may limit services and could prevent us from continuing the engagement if it interferes with necessary operations.
2. Information We Collect from Suppliers
We may collect the following information from Suppliers (collectively, “Personal Information”):
- Mobile number and alternate number
- Email address
- GST certificate / PAN card
- Cancelled cheque
- Shipping address and billing address
- Preferred pickup time
- Any other ancillary information required to carry out our operations
Some of the above may constitute “sensitive personal data or information” under the Information Technology Rules, 2011. Where applicable, such information will be collected, used, stored, and processed in accordance with those Rules.
We may share your information with third parties solely for onboarding and engagement purposes (for example, KYC and related checks) with your explicit consent. When shared, your information will be subject to the third party’s privacy policy and terms of use.
Non‑Personal Information and Cookies
When you visit or use the Platform, we may collect non‑personal information (“Non‑Personal Information”), such as location, browser type, IP address, device identifiers, internet service provider details, date/time/duration of Platform use, pixel tags, and general demographic data. We may also collect certain information about the device you use to access the Platform to facilitate, evaluate, and verify your usage.
The Platform uses cookies—small text files placed on your device that contain a unique identifier. By using the Platform, you consent to our use of cookies. Our cookies help maintain and improve Platform functionality and support research and development. We do not store personally identifiable information in cookies. The use of cookies by our partners, affiliates, advertisers, or service providers is not covered by this Policy.
3. How We Use Supplier Information
We (or authorized third parties) may use your information for:
- Order placement and management through the Platform
- Supplier order acceptance and fulfillment via the Platform
- Communications about products (specifications, quality, quantity), dispatch and delivery schedules, shipping addresses, returns and refunds
- Supplier ID creation following KYC approval
- Marketing and advertising communications
- Performing our contractual obligations and processing transactions
- Notifying you about changes to the Platform
- Notifying you, where feasible, of security incidents and taking reasonable remedial action
- Complying with legal and regulatory obligations
- Preventing fraud or potentially illegal activities
- Providing technical support for the Platform
We will retain your information for as long as necessary to meet legal obligations, resolve disputes, and enforce our agreements.
4. Storage and Security of Information
We employ appropriate technical and organizational measures designed to protect the integrity and security of your information and to mitigate the risk of unauthorized access, loss, theft, reproduction, use, alteration, disclosure, or destruction. We use secure servers and industry‑standard safeguards for conducting secure transactions and periodically review our information collection, storage, and processing practices.
If you receive a Supplier ID, you are responsible for keeping your login credentials confidential. By submitting information on the Platform, you consent to handling your information in accordance with this Policy.
While we strive to protect your information, transmission of data over the internet carries inherent risks and absolute security cannot be guaranteed. Your use of the Platform is at your own risk.
We are not responsible for any loss, damage, or misuse of your information caused by a Force Majeure Event (events beyond our reasonable control, including but not limited to sabotage, fire, flood, explosion, acts of God, civil commotion, strikes, riots, war, governmental actions, hacking, unauthorized access, system crashes, security breaches beyond our control, or power failures). We retain information for the period required by applicable law or for our internal use, whichever is longer.
5. Disclosure of Information
We do not rent or sell your Personal Information. We share Personal Information only as described in this Policy and our Terms of Use, limiting disclosure to those with a need‑to‑know for providing business, professional, or technical support connected to the engagement. However, we are not responsible for the security practices or actions of third parties who receive your Personal Information.
We may disclose information as necessary or appropriate: (a) under applicable law (including outside your country of residence); (b) to comply with legal process; (c) in response to requests from public or governmental authorities (including outside your country of residence); (d) to enforce our Terms of Use; (e) to protect our operations or those of our affiliates; (f) to protect the rights, privacy, safety, or property of us, our affiliates, Suppliers, or others; and (g) to pursue available remedies or limit damages.
We assume no liability for disclosures due to transmission errors, unauthorized third‑party access, or acts beyond our reasonable control. You agree not to hold us responsible for security breaches unless directly caused by our gross negligence or willful default.
6. Review and Updates
We review and update this Policy periodically. Please check it regularly. It is important that the information we hold is accurate and current; please inform us of changes during your engagement. We are not responsible for inaccurate information you provide that may affect your experience.
We may amend this Policy at any time, with or without prior notice. Where there are significant changes in how we treat Supplier information, we will display a notice on the Platform.

Governing Law and Dispute Resolution
This Policy is governed by and construed in accordance with the laws of the Republic of India. The courts at Pune, Maharashtra shall have exclusive jurisdiction over disputes arising out of or in connection with this Policy.
8. No Waiver and Severability; Unsolicited Information
Rights and remedies available under this Policy may be exercised as often as necessary, are cumulative, and not exclusive of those provided by law. Any waiver must be in writing. Delay or failure to exercise a right does not constitute a waiver of that or any other right.
If any provision of this Policy is held invalid or unenforceable, the remaining provisions will continue in full force and effect. This Policy applies only to information collected by the Company directly from Suppliers. It does not apply to unsolicited information you provide to us via the Platform or other means. All unsolicited information will be deemed non‑confidential, and we may use or disclose such information without limitation.
